Who we are and what these terms cover
These terms are an agreement between you and Igor Joshevski, a private individual, 90491 Nürnberg, Germany ("we", "us"). Idioloo is offered free of charge and not for commercial purposes. The terms apply to the Idioloo app for iOS and Android and to the website idioloo.com. By downloading, installing or using Idioloo you agree to them. If you do not agree, please do not use Idioloo.
How we handle personal data is described in the privacy policy. Who we are is set out in the imprint.
The service
Idioloo is a speaking-first language learning app. In its first version it teaches German to English speakers, from level A1 to C1: you hear words and sentences, say your answers out loud, practise in role-plays, review what you learned, and follow your progress. The app is free to download and use. It shows no ads and sells nothing.
There are no accounts. Your progress and settings are kept on your phone, so you are responsible for keeping them: use Settings → Your data to export a progress file if you want a backup or want to move to another phone. If you reset your data or remove the app without an export, we cannot restore your progress.
Who may use Idioloo
Idioloo is intended for people aged 13 and over. If you are under the age of majority where you live, you may use Idioloo only with the permission of a parent or guardian, who agrees to these terms on your behalf. You need a compatible phone or tablet (iOS 17 or later, or Android 12 or later) and, for lessons, a working microphone.
Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Idioloo on devices you own or control, for your own non-commercial learning, in line with these terms and the rules of the store you got it from. We keep all rights that we do not expressly give you.
Apple App Store and Google Play
If you got Idioloo from the Apple App Store or Google Play, the following also applies:
- These terms are between you and us, not with Apple or Google. We, not Apple or Google, are responsible for Idioloo and its content, for support and maintenance, and for any claims about it.
- Your use must also follow the store's terms (for Apple, the Apple Media Services Terms and Conditions; for Google, the Google Play Terms of Service) and any usage rules set there.
- If Idioloo does not meet a warranty that applies by law, you may tell the store, which may refund the purchase price (for Idioloo, which is free, there is none). Apple and Google have no other warranty duty for Idioloo.
- Apple and Google are not responsible for claims that Idioloo or your use of it infringes the intellectual property rights of a third party; we are.
- You confirm that you are not in a country under a government embargo or listed as a restricted party, and that you follow the laws that apply to your use.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you for iOS users.
Using Idioloo fairly
You agree not to:
- copy, modify, translate or distribute the app, its content packs or models, except as the law allows;
- reverse engineer, decompile or try to extract the source code, except where the law gives you that right despite this clause;
- extract learning content in bulk, for example with automated tools, or use it to train other systems;
- bypass or interfere with the app's security or technical protections;
- use Idioloo unlawfully, or in a way that harms or overloads our servers or those of our providers;
- send us feedback or support requests that are unlawful, abusive or misleading.
Learning content, feedback and estimated level
- Content. Learning content is generated with the help of artificial intelligence and is not always reviewed by a person. Freelance official translators review it, but review is ongoing, so some content has not been checked yet and may contain mistakes, such as a wrong word, a wrong translation or an unnatural sentence. Idioloo supports your learning; it does not replace a teacher or a course, and you should not rely on it where a mistake would matter, for example for an official text or an exam. You can report a mistake from the exercise in the app.
- Feedback on your speech. Whether an answer is marked correct depends on automatic speech recognition and on rules in the app. Recognition can be wrong, for example in noisy places or with unusual accents. Treat the feedback as guidance.
- Estimated level. The level shown in the app (A1 to C1) is an estimate, based on the material you have covered, which relates to what people learn at official language schools. We do not guarantee that you are really at that level. It is not an exam result, an official certificate or a certified assessment, and it is not issued or endorsed by any examination body or school. To find out your actual level, take an official test at an official language school.
- No guarantee of results. How fast you learn depends on you. We do not promise that you will reach a particular level or pass any exam.
What you send us
Your spoken answers are processed to give you feedback and are not stored by Idioloo. If you send us feedback or an e-mail, you stay the owner of what you write. You allow us to use it, free of charge and without a time limit, to evaluate your request and to improve Idioloo, including ideas you suggest, without owing you payment or credit. Please do not send anything you do not want us to read.
Ownership and licences
Idioloo, including its software, design, texts, learning content, audio, illustrations, mascot, name and logo, belongs to us or our licensors and is protected by copyright and other laws. Idioloo uses open-source and third-party components under their own licences; you can see them in Settings → Privacy and about → Licences.
Availability and changes
We work to keep Idioloo available, but we do not promise that it will run without interruption or errors. Some features need an internet connection (for example the first download of content and translation models) or services of your phone (speech recognition, voices), which we do not control. We may change, add or remove features, content or the free offer, and we may stop Idioloo altogether. Later, ads may help support Idioloo, and a one-time purchase would remove them; the terms for that would be added to these terms before it happens. Where we do, we will take your interests into account, for example by giving notice in the app where that is reasonable.
Warranty and liability
Idioloo is provided free of charge. As far as the law allows, we provide it "as is", without warranty for specific results or for uninterrupted or error-free operation.
We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, under the product liability law, and where the law does not allow liability to be excluded or limited.
For slightly negligent breach of an obligation that is essential for the purpose of the contract, our liability is limited to the damage that is foreseeable and typical for this kind of contract. We are otherwise not liable for slightly negligent breaches of non-essential obligations. These limits also apply to the personal liability of our employees and representatives.
Mandatory consumer protection rules of the country where you live stay unaffected. Nothing in these terms limits your statutory rights as a consumer.
Ending your use
You can stop using Idioloo at any time by removing the app; use Settings → Your data → Reset all data first if you want to delete your progress. We may suspend or end your access if you seriously or repeatedly break these terms, or if we stop offering Idioloo. Clauses that by their nature continue to apply (such as ownership and liability) remain in force.
Governing law and courts
These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you usually live, and you may bring a claim in the courts of that country.
If a provision of these terms is invalid, the rest stays valid.
Changes to these terms
We may change these terms, for example when the app, the law or our offer changes. The date at the top shows the latest version. If a change is significant, we will tell you in the app or on this website before it takes effect. If you keep using Idioloo after the change takes effect, you accept the new terms; if you do not agree, please stop using Idioloo.
